These Terms of Service ("Terms") govern your access to and use of the Nimphy website and AI companion services (the "Service"), operated by Nimphy ("we", "us" or "our"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

The Service is intended exclusively for adults. You must be at least 18 years old, or the age of majority in your jurisdiction if higher, to create an account or use the Service. By using the Service you represent and warrant that you meet this requirement.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use. You may sign in using email and password or a supported third-party provider such as Google, Discord or Apple.

Nimphy lets you chat with AI companion characters, create your own companions, and generate images and videos. All characters are fictional and AI-generated. Conversations and generated media are produced by artificial intelligence and may be inaccurate, and they do not represent real people, advice or facts.

You agree not to use the Service to:

Certain features require a paid subscription or virtual "gems". Prices are shown before purchase. Gems have no cash value, are non-transferable, and are non-refundable except where required by law. Subscriptions renew automatically until cancelled; you can cancel at any time and will retain access until the end of the current billing period.

The Service, including its software, design and branding, is owned by Nimphy and protected by intellectual property laws. Subject to these Terms, we grant you a limited, personal, non-exclusive licence to use the Service. You retain your rights in the content you create, and you grant us the licence necessary to host, process and display it so we can operate the Service.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free or secure, or that AI-generated content will be accurate or suitable for any purpose.

To the fullest extent permitted by law, Nimphy will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or revenue, arising out of or related to your use of the Service. Our total liability for any claim will not exceed the amount you paid us in the twelve months before the event giving rise to the claim.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or if we are required to do so by law. Provisions that by their nature should survive termination will continue to apply.

We may update these Terms from time to time. When we make material changes we will update the date above and, where appropriate, notify you within the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
